L.F. was charged with FTCx2. L.F. had was on bail for drug related charges. The bail L.F. was on stated that he was to observe a curfew and not carry a cellphone. L.F. was pulled over by the police in a vehicle that belonged to his mother. Upon further investigation, the police discovered that he was out past his bail. A further search of the vehicle by the police turned up a cellphone. Mr. Alawi was able to show through cross-examining the two police officers who had investigated and then arrested L.F. that there was no basis to stop L.F.
Result: L.F. was acquitted
D.M. was charged with FTC. D.M. was found at the mall allegedly smoking Marihuana with a group of other people. D.M. was on a bail with a condition that he be on house arrest. D.M. was not permitted to leave without a surety. D.M. was observed running down the stairs to where a waiting police officer was positioned. The officer arrested D.M. and charged D.M.
Result: D.M.’s charges were withdrawn
T.Y. was charged with assault with a weapon, uttering death threats, possession of property obtained by crime and fail to comply probation in relation to an argument with T.Y.’s neighbour. T.Y. was acquitted of the more serious charges at the end of a 5 day trial and was convicted of one count of uttering a death threat.
Result: T.Y. was acquitted of assault with a weapon and possession of property obtained by crime, while the charge of fail to comply probation was withdrawn. T.Y. was only found guilty of one count of uttering a death threat.
I.O. was charged with Possession of a Controlled Substance after a police officer responded to a call that a car had been involved in a single vehicle accident. The police officer who attended found I.O.’s car stuck in a ditch which separated north and southbound traffic on the highway. The officer investigated I.O. and discovered 25grams of Marihuana and charged I.O. with Possession of a Controlled Substance.
Result: I.O.’s charges were withdrawn
D.M. was charged with FTC after getting into an argument with a family member. D.M. left the house alone thereby breaching D.M.’s house arrest condition. D.M.’s surety called the police to inform them that D.M. had left. The police located D.M. a short time later and charged D.M. with fail to comply.
Result: D.M.’s charges were withdrawn
I.O was pulled over by a police officer because his modified vehicle had a loud muffler. After an investigation, the police charged I.O. with possession of a controlled substance. I.O.’s charges were withdrawn after it became evident to Mr. Alawi that there was a substantial amount of disclosure missing that likely would have supported I.O.’s version of events.
Result: I.O.’s charges were withdrawn
E.M. was charged with assault and michief as a result of a fight with the person E.M. had been dating at the time. E.M. was alleged to have assaulted the complainant and caused over $1000 worth of damages to the complainant’s residence.
Result: E.M.’s charges were withdrawn
